Terms of Service

These Terms govern your use of the TravelFairly iOS app and website (the "Service"), operated by TravelFairly ("we", "us"). By using the Service you agree to these Terms and to our Privacy Policy. You must be at least 13 years old (16 in the EU) and able to enter a binding contract to use the Service.

1. What TravelFairly does

TravelFairly tracks hotel prices across booking sites and notifies you when a price drops, so you can decide whether to rebook. The Service is informational only — we are not a travel agency, we do not sell rooms, and we do not process your bookings. You book directly with the hotel or the site of your choice.

2. No guarantee of savings

Prices, percentages, and examples shown in the app and on our website are illustrative and not guarantees. Hotel prices change constantly and may rise as well as fall. We cannot guarantee that a tracked price will drop, that you will save money, or that a rate we surface will still be available when you book.

3. Subscriptions, trials & billing

TravelFairly is a paid subscription with a 7-day free trial on each plan. There is no free tier.
Subscriptions are auto-renewable. Your payment method is charged through your Apple App Store account at the end of the trial and at the start of each renewal period, unless you cancel at least 24 hours before the period ends.
Manage or cancel anytime in your App Store subscription settings. Deleting the app does not cancel a subscription.
All payments are handled by Apple under its terms; we do not process or store payment details.
Refunds are handled solely by Apple under the App Store terms — we cannot issue refunds, and partial or unused periods are not refundable except where required by law.

4. Acceptable use

You agree not to misuse the Service, including: reverse-engineering it, scraping or overloading it, interfering with its operation, or using it for any unlawful purpose.

5. Third-party sites & data

We display prices and links from third-party booking sites. We do not control those sites and are not responsible for their prices, availability, content, or the bookings you make with them. Their terms apply to your dealings with them.

6. Apple Standard EULA

Your use of the iOS app is also governed by Apple's standard Licensed Application End User License Agreement, available at apple.com/legal/internet-services/itunes/dev/stdeula. Where these Terms conflict with that EULA for the iOS app, the EULA governs.

7. Intellectual property

The Service, including its design, branding, and content, belongs to us and is protected by law. We grant you a limited, personal, non-transferable license to use it under these Terms.

8. Disclaimer, liability & indemnity

The Service is provided "as is" and "as available", without warranties of any kind. To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages, or for any decisions you make based on prices or alerts shown in the Service.

You agree to indemnify and hold TravelFairly harmless from any claims, losses, or expenses (including reasonable legal fees) arising from your misuse of the Service or your breach of these Terms.

9. Changes & termination

We may update these Terms or the Service at any time. Continued use after changes means you accept them. We may suspend or end access that violates these Terms.

10. Governing law

These Terms are governed by the laws of the State of New York, United States, without regard to conflict-of-law rules.

11. Miscellaneous

These Terms are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a right is not a waiver of it. You may not assign these Terms; we may assign them to a successor. We are not liable for delays or failures caused by events beyond our reasonable control.
